
H-2A Visas
Allow U.S. employers to bring foreign workers for temporary or seasonal agricultural jobs
Requirements:
To qualify for the H-2A program, the job offered must be temporary or seasonal in nature. The employer must demonstrate that there are not enough U.S. workers who are able, willing, qualified, and available to do the work. Additionally, hiring H-2A workers must not adversely affect the wages or working conditions of similarly employed U.S. workers. Employers typically need to obtain a temporary labor certification from the U.S. Department of Labor as part of the process.
Eligible Countries:
H-2A visas are generally only issued to nationals from countries designated by the Secretary of Homeland Security, with the list updated annually in the Federal Register. In some cases, individuals from non-listed countries may still be eligible if their admission is deemed to be in the interest of the United States.
